Mutual consent procedure
The chronological course of a mutual consent divorce
A clear sequence of filings and waiting periods, from the draft agreement to notary registration. This page is general information and does not replace personalized legal advice.
The formal progression
From negotiation to registration
01
Negotiation of the agreement
The spouses and their lawyers draft the convention that sets out the terms of the divorce, including property, children, and support.
02
Fifteen-day reflection period
The draft convention is sent by registered post. The mandatory 15-day reflection period begins on the date of receipt, and each spouse keeps the right to reflect before signing.
03
Joint signature
Both parties and their respective lawyers sign the convention together during a single, simultaneous meeting.
04
Notary deposit
The signed convention is deposited with a notary within seven days of signature, which gives it its definitive enforceable date.
Documents to prepare
Records and filings to gather
Keep these items together in one folder so each stage of the file can be tracked against the calendar. Confirm current requirements with the official French sources listed on each topic page.
Civil registry
Civil status records
Recent copies of marriage and birth certificates, issued by the relevant civil registry, to identify the spouses and any children.
Finances
Financial attestations
Statements showing income, assets, property holdings, and debts, which support the division of property described in the convention.
Notary
Notary registration filings
The signed convention and the supporting records prepared for the notary deposit, which establishes its enforceable date.
